Participants Regulations

A) Definitions of Organizers and Participant.

In these regulations the term 'Organizers' refers to The Malcolm Group (Events) Ltd, (MGE) or their appointed Agents. The term 'Participant' refers to any company, business, corporation, group or individual to whom space has been allocated at a Malcolm Group Events Ltd. organized event (hereinafter referred to as the 'Event') for what ever reason be it selling, performing, demonstrating, exhibiting of some other purpose.

B) Allocation of Space.

This will be allocated in the order that contracts are received by the Organizers. If all space has been allocated to that particular product range or service described overleaf, then the Organizers reserve the right to refuse space allocation and neither party has any liability.

C) Space Allocation and Event Plan.

The Organizers reserve the right to alter the plan of the Event at any time and at their discretion in the interest of presentation of the Event and while they will endeavour to allocate the exact space requested and in the position requested they may without any reason allocate a smaller space, and in a different location, without penalty.

D) Alteration or Cancellation of Allocation by Organizers.

The Organizers may cancel allocations at any time on reasonable grounds or alter location of allocation or change dimensions to a smaller space in their absolute discretion. If an allocation is cancelled without a new one substituted, a full refund will be made. If a smaller space is allocated, a refund will be made amounting to the difference between the space originally allocated and the new allocated space.

E) Charges.

The total charge booked represents a product of the minimum space charge plus the charge per running foot multiplied by the number of additional running feet applied for and any additional charges.

F) Liability for Loss, Damage, Accidents, Theft etc.

All Participants take part in the Event in every way at their own risk, including that from fire, flooding or loss through damage, theft, accident to stand fitting, exhibits, furniture or any of their belongings, whatsoever the cause during the Event itself or during the erection or dismantling of stands or at any time the Participant's property is in the confines of the Event area including the parking area. The Participant is responsible for all personal injury or damage to property arising in connection with the erection and dismantling of the Participant's stand and anything permitted, omitted or done by the Participant during the period of the exhibition and the setting up and dismantling the same should be insured.

G) Consequential Loss.

Participants are advised to insure against costs and losses which they may incur in the event of the Event being cancelled, suspended or abandoned in whole or part for causes beyond the Organizers control, since the Organizers accept no liability in such eventuality.

H) Participants Conduct, etc.

If any Participant or employee, guest, agent or contractor of the Participant conducts himself, either by demonstration of his goods or in any other way as to be objectionable to Participants, Participant's employees or agents or visitors, he shall at the Organizers discretion be banned from the Event grounds and only be allowed to return when the Event is over.

I) Unsuitable Exhibits.

Only goods described at the time of application may be displayed at the allocated space, and goods considered unsuitable in any way by the Organizers must be removed from the Event grounds.

J) Occupation of Stands.

Participants must conduct their business from the confines of their stand area, and exhibits must not intrude into public areas. Participants may only distribute advertising material elsewhere at the Event by written application to the Organizers. Stands must be occupied at all times during the advertised times of the Event by the Participant or Participant's employee and all exhibits must be kept on view at all times while the Event is open. Participants may not remove any exhibits or dismantle in any form any stand fitting until the Event closes on the final day.

K) Payment.

Cheques should be crossed and made payable to The Malcolm Group (Events) Ltd. and submitted concurrent with this contract.

L) Event Buildings and Temporary Structures (where applicable).

The building structure, flooring and roofing must not be damaged in any way by the Participant nor may the building structure be used to display Participants' advertising material or directional signs, unless written permission has been previously obtained from the Organizers.

M) Electrical Installations.

No electrical power will be supplied by the Organizers unless arrangements are made at the time of booking. All other electrical installations shall be obtained by the Participant at his own expense and installations are subject to approval by a representative of the Organizers, the local Council or the Fire Authorities.

N) Regulations and Directions.

The Organizers may at any time before, during or after the Event give reasonable directions to Participants or Participants' employees, agents or contractors, and reserve the right to change or make new regulations at any time in their absolute discretion.

O) Disputes.

The contract shall be deemed to have been compiled at the address overleaf and Participants and Organizers hereby agree that any dispute or claim arising out of this contract shall be submitted to the jurisdiction of the county court appropriate to the said aforementioned address.

P) Noise.

All Participants displaying any items making a noise must keep them at a volume such that annoyance is not made to other Participants or the public. Acceptable sound levels will be at the absolute discretion of the Organizers. If this request is not adhered to, then the Organizers reserve the right to turn them off completely.

Q) Infringement of Regulations.

The infringement of any of the above regulations will subject the Participant to forfeiture of his stand space and to the removal of his goods, his person and his employees or agents from the Event without the Organizers or their contractors being subject to any liability as a consequence of the removal. Nor shall such removal release the Participant from any payment for which he is still liable, whether any infringement has been made by the Participant, his agents or employees or contractors shall be at the sole discretion of the Organizers.

R) Abandonment.

If for any reason the Event cannot be opened or held at the site then the Organizers shall declare the Event abandoned. In the event of the Event being abandoned the Organizers shall be entitled to retain or receive on account of working expenses 50% of the charges stated in item E. The balance will be repaid by the Organizer to the Participant. If the Event is open to the public for at least one of the Event days but has to be abandoned on one or more of the other public days for reasons such as weather then no refund will be forthcoming to the Participant.

S) The Participant agrees to allow MGE to use pictures of them participating at HCMF which have been taken on this or previous years HCMF for any and all advertising and promotional purposes and has unrestricted use of these images, without any royalty or payment.

T) This form is copyright to the Malcolm Group Events Ltd. Any reproduction of it in whole or in part is strictly prohibited.
